On June 30, 2019, on his personal Instagram page, which currently has\nmore than 1.8 million followers, Plein posted an image of a green pair of his\nbranded sneakers atop the rear of his green Ferrari with the caption \u201c50 shades\nof \ud83c\udf4f \ud83c\udf4f \ud83c\udf4f.\u201d Again, on July\n29, 2019, Plein posted another image, which included the same green sneakers\natop the hood of (presumably) the same green Ferrari. In response to this\nseries of images, Ferrari sent its letter.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\nthe letter, Ferrari claims Plein is using Ferrari\u2019s trademarks \u201cfor promotional\npurposes of your brand and products, unlawfully appropriating the goodwill\nattached to them.\u201d A trademark owner reserves the exclusive right to use its\nmark in connection with the specific goods or services associated with the same\nin commerce. Infringement occurs when a second-in-time party uses a similar\nmark in a manner that is likely to confuse consumers into believing the junior\nparty\u2019s products or services are sourced by, affiliated with, or sponsored by\nthe trademark owner. The concern is that the junior user will wrongfully\nbenefit from the senior user\u2019s goodwill.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Ferrari\nalso accuses Plein\u2019s images of tarnishing the Ferrari brand. In particular,\nFerrari states \u201cFerrari\u2019s trademarks and model cars are associated in your\npictures with a lifestyle totally inconsistent with Ferrari\u2019s brand perception,\nin connection with performers making sexual innuendos and using Ferrari\u2019s cars\nas props in a manner which is per se distasteful.\u201d Plein\u2019s Ferrari is featured\nin multiple other Instagram posts by Plein, many of which include scantily clad\nfemales draping their bodies over the car or otherwise interacting with the\nvehicle in a sexually-suggestive manner. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Tarnishment\nis a type of trademark dilution which occurs when a famous mark is linked to\nproducts of poor or questionable quality, or is portrayed in an unwholesome or\nunsavory context. In this way, the reputation of the mark is harmed. Thus, it\nappears to be Ferrari\u2019s concern that Plein\u2019s marketing of his brand, including\nthe green shoes, in a manner which includes sexual innuendo will harm Ferrari\u2019s\notherwise pristine brand. Notably, none of the complained-of photographs\nfeaturing Plein\u2019s actual products appear to include such sexually explicit\ncontent.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Philipp\nPlein is a German fashion designer. Starting in the late 1990\u2019s, Plein\u2019s first\ncollections featured vintage military jackets which he embroidered with\nSwarovski skulls. Plein\u2019s namesake casual fashion brand was born in 2004 and\nthe luxury read to wear label was launched in 2008. Now, Plein\u2019s collections\nrange from all types of men, women, and junior clothing, shoes, and\naccessories. Indeed, Plein is the Founder and Chief Executive Officer of the\nPhilipp Plein International Group which includes the Philipp Plein, Plein\nSport, and Billionaire Couture brands. Moreover, Plein has worked with numerous\nnotable celebrities including Mischa Barton, Lindsay Lohan, Snoop Dogg, Rita\nOra, Naomi Campbell, Iggy Azalea, Grace Jones, Theophilus London, Fergie, Chris\nBrown, Jeremy Meeks, and Floyd Mayweather.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\nhis series of posts, Plein further alleges the letter constitutes blackmail,\nbased on the forty-eight hour window it provides for Plein to remove the images\nfrom all media. Plein states \u201cFERRARI GAVE ME AN ULTIMATUM OF \u201848\u2019 hours to\nremove a photo of my PERSONAL FERRARI FROM MY PERSONAL INSTAGRAM !!!!!!\u201d Plein\nalso claims \u201c[t]his is a clear BLACKMAIL !!!!!\u201d Plein\u2019s frustration stems from\nthe fact, as he claims, that he has purchased four new Ferraris in the past ten\nyears and is therefore, a very loyal customer of the luxury car brand. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Cease\nand desist letters are commonly preludes to litigation. The purpose of the\nletter is to educate the infringer about the trademark owner\u2019s rights, put the\ninfringer on notice of the infringing activities, and make specific demands,\nwith an implied or explicit threat of legal action if the concerns contained\ntherein are not addressed. While it is doubtful such a standard letter would\nconstitute blackmail, Plein\u2019s other points as to Ferrari\u2019s treatment of loyal\ncustomers are well-founded.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Finally,\nin one of his Instagram posts, Plein ponders \u201cAnd if I don\u2019t remove it you will\ndo what ???
