In particular, TEB Capital Management,\nInc., Brady\u2019s management company, filed two applications, one in International\nClass 16 for \u201ccollectible trading cards; sports trading cards; posters; printed\nphotographs\u201d and one in International Class 25 for \u201ct-shirts; shirts.\u201d In\nresponse, the USPTO issued identical rejections to both applications based on\nwhat is known as \u201cfalse connection\u201d and \u201cname of living individual.\u201d<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\nUSPTO examining attorney\u2019s first refusal, \u201cfalse connection,\u201d provides \u201cthe\napplied-for mark consists of or includes matter which falsely suggests a\nconnection with Tom Seaver.\u201d Moreover, the examiner states that \u201cTom Seaver is\nso well-known that consumers would presume a connection.\u201d Tom Seaver is a\nformer American baseball player who pitched in Major League Baseball from 1967\nto 1988 for the New York Mets, Cincinnati Reds, Chicago White Sox, and Boston\nRed Sox. In this time, Tom Seaver apparently received the nickname \u201cTom\nTerrific.\u201d <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A\nfalse connection exists when the applicant\u2019s applied-for goods or services are\nof a type that the named person or institution sells or uses, and the named\nparty is sufficiently famous such that it may be inferred that the purchasers\nof the goods or services would be misled into making a false connection of\nsponsorship, approval, support, or the like with the named party. In the\npresent situation, the examiner provides that based on the evidence provided in\nthe letter of protest, including news articles, encyclopedia excerpts, and\ncolumns, the nickname \u201cTom Terrific\u201d refers to Tom Seaver.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\nexamining attorney\u2019s \u201cfalse connection\u201d decision is based on a letter of\nprotest that was received by the USPTO in conjunction with Brady\u2019s application.\nA letter of protest may be filed by a third party who wishes to bring to the\nattention of the USPTO evidence bearing on the registrability of a mark. Such\nprocedure applies only to pending applications and is intended to aid in the\nexamination process without causing undue delay. When a letter of protest is\nreceived by the USPTO, the Office of the Deputy Commissioner for Trademark\nExamination Policy first reviews the document to determine whether the\nsubmitted information should be given to the examining attorney assigned to the\nrelevant application for consideration. In so doing, the Deputy Commissioner\nconsiders only the record in the application and the evidence submitted by the\nprotestor.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\n\u201cfalse connection\u201d rejection differs from a classic likelihood of confusion\nrejection in two important regards. Primarily, a \u201cfalse connection\u201d refusal\nrequires the potential for confusion to be based on association with a\nparticular individual, either through use of that individual\u2019s nickname or\ngiven name. Additionally, for a claim of false connection, a party need not\nallege proprietary rights in the name for purposes of standing.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\nUSPTO examiner further rejected Brady\u2019s application based on \u201cname of living\nindividual\u201d in stating that \u201cTom Terrific\u201d identifies Tom Seaver, because it\nwas his nickname. More specifically, the USPTO examining attorney stated that\nregistration was refused \u201cbecause the applied-for mark consists of or comprises\na name, portrait, or signature identifying a particular living individual whose\nwritten consent to register the mark is not of record.\u201d An applied-for mark\nwill identify an individual if the person bearing the name is so well known\nthat the public would reasonably assume a connection or the person is publicly\nconnected with the business in which the mark is used. Such a rejection applies\nto nicknames as well as legal names. In this way, the examiner contends \u201c\u2019TOM\nTERRIFIC\u2019 points uniquely and unmistakably to Tom Seaver.\u201d<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Even\nif Tom Brady remains unable to register \u201cTom Terrific\u201d as a trademark with the\nUSPTO, registration is not a requirement to trademark rights. An unregistered,\nor common law, trademark is a mark which is enforceable by virtue of its\nability to signify or distinguish a product or service as belonging to a\nparticular source. However, an unregistered trademark does not provide the\ntrademark owner the same extent of protection as the owner of a federal or\nstate registered mark. For example, as opposed to federally registered\ntrademarks, common law trademarks are usually enforceable only within the\ngeographic region or locale where the trademark owner is using it in business.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Not\nonly has the USPTO rejected the mark\u2019s registration, the attempt has been\nwidely panned in New York City, where Tom Seaver is widely remembered.
