Most recently, Seinfeld filed a motion to dismiss, which was granted\nlast month.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Charles and Seinfeld had previously worked together on\nseveral projects, although none of them ended in lawsuits. Indeed, the pair had\nan eighteen year long working relationship. As one example, as alleged in\nCharles\u2019 complaint, Charles co-created and directed \u201cComedian,\u201d a documentary film\nabout the comedian. A producer, Gary Streiner, researched extensively camera\nequipment as well as the logistics of uninterrupted filming in a moving\nvehicle. Initially, the show was to be called \u201cTwo Stupid Guys In A Stupid Car\nDriving To A Stupid Town\u201d or alternatively, \u201c\u201967 Bug.\u201d In 2002, Charles pitched\nthe talk show idea to Seinfeld, who allegedly rejected the notion, claiming he\nhad no interest in another television show.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In 2011, Seinfeld allegedly approached Charles with an\nidea about a talk show featuring comedians driving to a coffee place and having\na conversation. Seinfeld sought Charles\u2019 assistance in developing the show.\nCharles claims he reminded Seinfeld that this concept was the same which was\npitched to him nearly a decade earlier, in 2002. Charles then created a new\ntreatment based on the idea described by Seinfeld, which Seinfeld approved.\nCharles worked to shoot and create the pilot episode, which Seinfeld \u201cexcitedly\nsupported.\u201d<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; After successfully pitching the pilot to Sony, Charles\nbegan preparing and location scouting for a follow-up episode featuring Alec\nBaldwin. Charles\u2019 representatives engaged in discussions to finalized terms with\nSeinfeld and Sony. In particular, Charles requested credit for his creative\ncontribution, Seinfeld\u2019s response responded that he alone deserved credit for\nthe show and that Charles was merely a work-for hire. After a number of phone\ncalls, all of which allegedly resulted in Seinfeld \u201cyelling,\u201d Charles was provided\nno further information as to next steps for the project and was ultimately shut\nout of production.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Traditionally, copyright law protects a work of\nauthorship from the moment it is created in a fixed form. Under this regime, only\nthe author of the work can rightfully claim copyright. However, an exception\nexists for \u201cworks made for hire.\u201d If a work is made for hire, an employer is\nconsidered the author even if an employee actually created the work. A work is\nmade for hire when the work is prepared by an employee within the scope of his\nor her employment or when the work is specially ordered to commissioned. Under either\noption, the parties must expressly agree in writing that the work is a work\nmade for hire.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Charles claims that he maintained the belief that\nSeinfeld would eventually acknowledge Charles alleged ownership rights and\nbring him back to the show, a belief that he finally got rid of about six years\nlater in 2016, which is when he registered his treatment of the show with the\nCopyright office. Charles then contacted Seinfeld in 2017, when the Netflix\ndeal with \u201cComedians in Cars Getting Coffee\u201d began. In February of 2018,\nCharles filed the lawsuit against Seinfeld, where he claims copyright\ninfringement of the treatment, script, and pilot, as well as claims for joint\nauthorship, injunctive relief, and multiple state law causes of action.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\nresponse to Charles\u2019 lawsuit, the defendants filed a motion to dismiss arguing\nthat Charles\u2019 copyright claims are time-barred. Civil actions for infringement\nunder the Copyright Act have a three-year statute of limitations. A statute of limitations\nis the maximum time after an event within which legal proceedings may be initiated.\nBecause Charles\u2019 claims accrued at least as of 2011, the court dismissed Charles\u2019\ncomplaint. In dismissing Charles\u2019 federal claims, the District Judge did so\nwith prejudice, which means Charles is barred from bringing an action on the\nsame claim.
