The England-based street\nartist is fighting back against the card company in an attempt to protect his\ntrademark.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Banksy has been active since the\n1990s as an anonymous street artist and political activist. Banksy is famously anonymous and made headlines last year for\nselling his Girl With Balloon painting for $1.4 million only for it to be\nshredded moments later. Banksy is using a shell company called Pest Control to\nhandle the dispute. Through Pest Control, Banksy has trademarked his artwork as\nwell as the word \u201cBanksy.\u201d The \u201cflower thrower\u201d\nwork, officially \u201crage, flower thrower,\u201d has been trademarked through Pest\nControl since 2014 and features a man with a bouquet of flowers in his hands in\na stance appearing as though he is ready to throw said bouquet.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Since Banksy registered his trademark\nfor \u201cflower thrower\u201d five years ago, and he has not used the mark within this\ntime period, such non-use is grounds for cancellation of the same in the European\nUnion as well as the United Kingdom. As such, Full Colour Blank has come forward\nto invalidate Banksy\u2019s registration for \u201cflower thrower\u201d in this manner. This\nsystem differs slightly from the United States, where, in order to register a\ntrademark, one must prove that they are actively using their trademark on goods\nor services in commerce. &nbsp;Banksy has\npublicly expressed his anger towards this situation, claiming the company is\nattempting to steal his name and artwork for their own profit.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In response, Full Colour Black has\nstated that they are not trying to steal or profit off Banksy\u2019s brand. They\nstate that they are merely using his \u201cflower bomber\u201d painting for\nornamental\/decorative purposes and not to claim an association with Banksy or\nhis brand. Moreover, they claim that obviously nobody would confuse their\nproducts for anything that relates to Banksy\u2019s brand. Full Colour Black also defends\nsuch practice by stating \u201cwe legally photograph public graffiti and make it\navailable to you \u2013 the public.\u201d However, this claim does not address the fact\nthat the company is doing so by selling, and therefore making a profit, on such\nallegedly \u201cpublic\u201d artwork. Instead, the card company accuses Banksy of \u201cnever\nmak[ing] anything available to his fans\u201d that \u201ccannot afford to buy one of his\nofficial canvases.\u201d<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In response to the lawsuit, Banksy\u2019s\nlawyers have advised him to open up a pop-up shop in order to protect his\ntrademark by maintaining its registration. The store, set up in the south\nLondon town of Croydon, was called \u201cGross Domestic Product<sup>TM<\/sup>\u201d with a\ntagline of \u201cWhere art irritates life.\u201d While not open about disclosing his\nidentity, in an explanation of the store, Banksy openly discloses \u201cThis shop\nhas come about as a result of legal action\u201d and that he \u201chas been advised the\nbest way to prevent this is to sell his own range of branded merchandise.\u201d This\nstorefront was opened with the purpose of demonstrating proof of use of the \u201cflower\nthrower\u201d and other trademarks, thereby allowing Banksy to fight the claim\nagainst his intellectual property. <\/p>\n\n\n\n<p>A trademarkis a word, phrase, symbol,\nand\/or design that identifies and distinguishes the source of the goods of one\nparty from those of others. A trademark is aimed at protecting the consumer by\nallowing them to know with certainty the source of certain products or\nservices. Copyright, on the other hand, is aimed at protecting the creator and\ntheir creations. Both copyright and trademarks give monopolistic rights that\nallow their owners to profit from their own creations, and preventing others\nfrom profiting from creations that do not belong to them. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Banksy, controversially, does not\ncopyright his work and has been quoted saying \u201ccopyright is for losers.\u201d\nInterestingly, then, it does not follow why Banksy would protect his work via\ntrademark. In one sense, perhaps because trademark laws are aimed at protecting\nconsumers by disallowing false associations of source for products and\nservices, while copyright protects the authors of works from infringement, Banksy\nfavors trademark. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Some commentators have speculated\nthat Banksy is against copyright not for moral or political reasons, but rather\nbecause in order to copyright his work, he would have to reveal his identity. However,\nthis claim is wholly untrue. In the United States, one may register their\ncopyright under a pseudonym and therefore need not reveal their true identity. Additionally,\nin the United Kingdom, there is no register of copyright works but instead, the\ncopyright owner is granted protection automatically upon creation of an\nartistic work.
