Nike is seeking damages in multiple areas,\nincluding those adequate to compensate for the alleged patent infringements,\nthe total profit realized by Skechers, supplemental damages, and profits for\nany continuing post-verdict infringement until final judgement. Nike is also\nasking for treble damages, that is, increased damages up to three times the\namount found or assessed. Finally, Nike seeks prejudgment and post-judgement\ninterest on any damages or profits awarded, along with attorneys\u2019 fees.&nbsp;<\/p>\n\n\n\n<p>A design patent protects the ornamental design of a product. While\nthe product may be functional, design patents do not protect the functionality\nof the patent. Rather, to protect the functionality of a product, a utility\npatent is needed. To demonstrate design patent infringement, the plaintiff must\nprove that an ordinary observer would be unable to distinguish between the\npatented design and the accused product when they are side by side. This is\nreferred to as the \u201cordinary observer\u201d test. More specifically, this test, as\nmost recently set forth by the Federal Circuit, provides that, \u201cif, in the eye\nof an ordinary observer, giving such attention as a purchaser usually gives,\ntwo designs are substantially the same, if the resemblance is such as to deceive\nsuch an observer, inducing him to purchase one supposing it to be the other,\nthe first one patented is infringed by the other.\u201d <\/p>\n\n\n\n<p>Notably, this has been modified to include the importance of prior\nart. Prior art includes any and all information that tends to show that a\nclaimed invention was already known or would have been obvious at the time the\npatent application was filed. In the context of design patent infringement, the\nordinary observer compares the patented design to the prior art. If the ordinary\nobserver determines that the patented design is close to the prior art, smaller\ndifferences between the accused product and the patented design will be more\nimportant to the ordinary observer in determining whether infringement has\noccurred.<\/p>\n\n\n\n<p>In the complaint, Nike asserts that Skechers previously admitted\nto taking inspiration from other sneaker companies and calling it\n\u201cSkecherizing.\u201d Nike believes that Skechers\u2019 CEO, Robert Greenberg is to blame\ndue to a Skechers corporate witness who previously testified that Mr. Greenberg\n\u201cgives orders to knock-off competitors\u2019 products.\u201d There is a difference\nbetween inspiration and infringement. One can be inspired by a product and use\nthat inspiration to either build upon what already exists, including ideas\nwhich are already patented. However, admiring a product so much that you simply\nrecreate and distribute under your brand for your own profit constitutes infringement.\nAs discussed above, Nike must prove that Skechers copied their patented designs\nby marketing and selling a design that is \u201csubstantially similar\u201d to their\npatented. design. Further, to receive the treble damages it seeks, Nike also\nmust prove that Skechers intentionally infringed its design.<\/p>\n\n\n\n<p>This lawsuit is not the first between Nike and Skechers. In\nparticular, Nike and its subsidiary, Converse, have filed previous lawsuits\nagainst Skechers for infringement. In the present complaint, Nike cites two\npending lawsuits against Skechers. One is for the alleged infringement of the\nConverse high top design and the other is for the patented Nike Free and\nFlyknit designs. In the present complaint, Nike included side by side comparison\nphotos for the two previusly pending lawsuits as well as the current dispute.\nNike also mentioned a YouTube video review of the Skech-Air Atlas shoe, where\nthe commentator describes the Skech-Air shoe as a \u201cblatant Nike VaporMax\nknockoff\u201d where they \u201cremove all the things that make VaporMax good and replace\nthem with BS.\u201d&nbsp;<\/p>\n\n\n\n<p>Nike asserts that, as a business, they invest heavily in research\nand design which lead to \u201cinnovative footwear designs and technologies.\u201d As\nsuch, they take their designs and ideas seriously and continually take steps to\nprotect their intellectual property. Skechers, however, has a completely\ndifferent view of its infringement litigation with Nike. According to a recent\npost by Skechers on Twitter, Nike has been notifying Skechers\u2019 retail partners that\nSkechers is infringing on Nike\u2019s patents. In response, Skechers asserts that\nNike is bullying them and that this is Nike\u2019s way of avoiding competing with\nSkechers. The court of public opinion apparently disagrees with Skechers. Numerous\nindividuals have responded to Skechers\u2019 Twitter with comments such as, \u201cyou\neven put AIR in the name,\u201d \u201ctheir creative department is an embarrassment,\u201d and\n\u201cNike isn\u2019t bullying you, they\u2019re just standing up for themselves.\u201d <\/p>\n","protected":false},"excerpt":{"rendered":"<p>On September 30, 2019, Nike filed a patent infringement lawsuit in the U.S District Court for the Central District of California against Skechers.
