More\nparticularly, Nirvana alleged copyright infringement, false designation of\norigin, trademark infringement, and unfair competition. In this way, Nirvana seeks\nto demonstrate that they are not associated with, nor do they endorse Marc\nJacobs. Further, Nirvana does not want the Marc Jacobs design to confuse\nconsumers into believing otherwise. Nirvana also included Saks Fifth Avenue and\nNeiman Marcus as co-defendants due to their carrying of the Bootleg Grunge Tee.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Copyright, patent, and trademark\nlaws exist in order to protect the creators of intellectual property as well as\nthe consumers thereof. A trademarkis a word, phrase, symbol, and\/or\ndesign that identifies and distinguishes the source of the goods of one party\nfrom those of others. A trademark is aimed at protecting the consumer by\nallowing them to know the exact source of certain goods or services. Trademark\ninfringement occurs when there exists the likelihood of confusing one product\nor service with another. <\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Copyright, on the other hand,\nprotects original works of authorship and is therefore aimed at protecting\ncreators by allowing them to profit from their original works. To prove\ncopyright infringement, the copyright holder must show that the copying party\nhad access to the original work and that the two works are substantially\nsimilar.&nbsp; Similarly, unfair competition takes place when there is an\nattempt to replace a product or service that already exists with the intention\nof deceiving the public.&nbsp;<\/p>\n\n\n\n<p>In this lawsuit, Nirvana claims that a Marc Jacobs shirt unlawfully\ncopied a design created by the late Kurt Cobain in 1991. The design in question\nis an iconic design associated with Nirvana, consisting of a yellow happy face\nagainst a black background with an \u201cX\u201d in the place of each eye, a squiggly\nupward facing smile, and a small tongue sticking out to the right. In Nirvana\u2019s\nmost common use of the design, they include \u201cNIRVANA\u201d printed in all capital\nletters also in yellow above the happy face design. The allegedly infringing Marc\nJacobs shirt includes the same happy face with tongue design, but instead with an\n\u201cM\u201d and a \u201cJ\u201d for eyes and the word \u201cHEAVEN\u201d appearing in yellow capital\nletters and a similar font to that of Nirvana\u2019s design above the happy face. It\nis important to note that Nirvana has been using this happy face design to\nidentify their music since 1992 and have used the design on all of its\nmerchandise, including short sleeved shirts similar to the one distributed by Marc\nJacobs.<\/p>\n\n\n\n<p><br>\n&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\nthe case\u2019s most recent development, U.S. District Judge John A. Kronstadt heard\nand decided Marc Jacobs\u2019 motion to dismiss. In its motion, Marc Jacobs\nprimarily argues that Nirvana does not possess a monopoly on the smiley face\ndesign by itself but rather, that its copyright registration covers additional\nelements, including \u201cNIRVANA\u201d above the face and the words \u201cflower sniffin kitty pettin baby kissin corporate rock\nwhores\u201d on the back of the t-shirt. Marc Jacobs further claims that to the\nextent Nirvana\u2019s copyright covers the smiley face design, it is a different one\nthan that found on the fashion designer\u2019s t-shirts, sweatshirts, and socks.\nMoreover, by replacing the smiley face\u2019s crosses\nfor eyes with the letters \u201cM\u201d and \u201cJ,\u201d and the word \u201cNIRVANA\u201d with \u201cHEAVEN,\u201d Marc\nJacobs argues that the design is not an exact replica of Nirvana\u2019s well-known\ndesign and therefore does not infringe the copyright.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Marc Jacobs\u2019 other primary argument in its motion to\ndismiss centered around how Nirvana\u2019s complaint allegedly contains no explanation\nof how Kurt Cobain, as original author for Nirvana\u2019s smiley face, transferred\nhis ownership rights to Nirvana. Only the legal or beneficial owner of an\nexclusive right under a copyright is entitled to institute an action for\ninfringement. Additionally, Marc Jacobs argues that the publication date on Nirvana\u2019s\ncopyright application is false and therefore, their registration is invalid.\nThe presumption of copyright validity may be rebutted in this way if Marc\nJacobs could sufficiently show that Nirvana knew the publication date was\ninaccurate and this inaccuracy would have caused the Copyright Office to refuse\nthe registration.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Motions to dismiss are granted when\nthe complaint lacks a cognizable legal theory or sufficient facts to support one.\nIf granted, the claims upon which it is based are dismissed from the case. If\ndenied, the case proceeds forward, potentially to trial. Here, Marc Jacobs,\nSaks, and Neiman Marcus attempted to dismiss all claims against them. In denying the motion to dismiss, the judge found Marc Jacobs\u2019 arguments\nunpersuasive. For one, the judge determined that Nirvana sufficiently alleged the\nsimilarities between Marc Jacobs\u2019 t-shirt design and the copyrighted design by\nincluding various images of the two designs and listing multiple similar\nfeatures. The court also found that Nirvana had sufficiently alleged ownership\nbecause the copyright registration lists Nirvana as its initial author. Finally,\nregarding Marc Jacobs\u2019 assertion that the date of publication of the\ncopyrighted design is inaccurate, the judge determined that Marc Jacobs failed\nto show that the date is indeed inaccurate and further that the plaintiffs knew\nof any such inaccuracy.
