In addition, Nespresso claimed the capsules\r\nthemselves infringed the coffee giant\u2019s trade dress. Overall, Nespresso alleges\r\nJones Brothers \u201cbuilt an entire business by unlawfully trading off Nespresso\u2019s\r\nvaluable assets and goodwill.\u201d<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Jones\r\nBrothers was founded in 2013 offering \u201cNespresso Compatible\u201d capsules for use\r\nwith Nespresso\u00ae machines and other brewers. Starting in the latter-half of\r\n2018, Nespresso issued multiple letters to Jones Brothers, placing Jones\r\nBrothers on notice of its allegedly infringing activities. In these letters,\r\nNespresso explained that Jones Brothers was improperly using Nespresso\u2019s\r\ntrademarks to advertise and sell its infringing capsules. Jones Brothers failed\r\nto respond to any of the three letters issued on behalf of Nespresso. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Nespresso\r\nis the exclusive licensee of a number of federally registered trademarks and\r\napplications covering the \u201cNespresso\u201d name. Societe des Produits Nestle S.A., which is otherwise known as Nestle,\r\nowns Nespresso and all of its intellectual property. As exclusive\r\nlicensee, Nespresso is authorized to use the Nespresso marks in connection with\r\nits products as well as, enforce the marks against infringers, such as Jones\r\nBrothers. As such, Nespresso argues Jones Brothers has caused it irreparable\r\nharm by improperly using Nespresso\u2019s trademarks to advertise and sell its\r\ncapsules. Further, in its complaint against Jones Brothers, Nespresso cites another\r\nlawsuit in which it was involved where the court held that the defendant\u2019s use\r\nof the phrase \u201cNespresso compatible\u201d prominently to advertise and sell its\r\nproducts constitutes trademark infringement. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Trademark\r\ninfringement exists where consumers are likely to be mistaken, confused, or\r\ndeceived as to the source of Jones Brothers\u2019 replica capsules. Thus, for Jones\r\nBrothers to be liable for trademark infringement, Nespresso would have to prove\r\nthat such likelihood of consumer confusion exists between Nespresso\u2019s protected\r\ncapsules and Jones Brothers\u2019 imitation version. In this way, Nespresso argued\r\nJones Brothers used the slogan \u201cNespresso Compatible\u201d on its website and\r\npackaging so as to \u201cfalsely suggest and\/or imply endorsement and\/or\r\nsponsorship, by, and\/or affiliation with, Nespresso.\u201d<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Nespresso\r\nalso argues the capsules marketed and sold by Jones Brothers are nearly\r\nidentical replicas of Nespresso\u2019s trade dress. Specifically, Nespresso claims\r\nJones Brothers\u2019 infringing capsules are identical in size, shape, colors, and\r\nappearance. Moreover, Nespresso points to the dimpled cone shape of the\r\ncapsules, which is identical to the iconic feature of Nespresso\u2019s capsule that\r\nconsumers readily and exclusively associate with Nespresso.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A\r\nsubset of trademark rights, trade dress protects the packaging, design, and\r\noverall feel and appearance of a product. Infringement of trade dress occurs\r\nwhen one product\u2019s design or packaging mimics that of another product to the\r\nextent there exists a likelihood of consumer confusion. If the trade dress is\r\nunregistered, it must be either inherently distinctive or have acquired\r\ndistinctiveness. Inherent distinctiveness means consumers automatically\r\nidentify the product with its source. Acquired distinctiveness, on the other\r\nhand, means the trade dress has become distinctive as applied to the relevant\r\ngoods or services in commerce.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Recently,\r\nthe case has settled. Attorneys for Nespresso submitted a letter to the judge\r\nstating \u201cthe parties have amicably resolved their differences and Nespresso\r\nvoluntarily dismisses\u201d its claims against Jones Brothers. Accordingly,\r\nNespresso filed a Notice of Voluntary Dismissal concurrently with the letter.\r\nWhile the terms of the settlement are confidential, Jones Brothers\u2019 website now\r\nshows adjusted packaging for its coffee capsules and further, the Nespresso\u00ae\r\nmark has a less prominent role.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; This\r\nlawsuit demonstrates how adjusting packaging and adding disclaimers can resolve\r\ntrademark infringement litigation. Indeed, Jones Brothers appears to continue\r\nto market and sell \u201cNespresso-compatible\u201d coffee capsules, but now does so in a\r\nmanner less likely to confuse consumers. As one example, the Jones Brothers\r\nwebsite now features a disclaimer at the bottom of each page stating, \u201cJones Brothers Coffee is not affiliated with,\r\nendorsed or sponsored by Nespresso.
