According to the lawsuit, Fossil had been a\r\nlicensee of Romag\u2019s patent-protected magnetic closures but had switched to an\r\nunapproved supplier, which Romag alleges sold counterfeit Romag magnetic snaps.\r\nThus, certain Fossil handbags sold in the United States were found to contain\r\nsaid counterfeit snaps. In this manner, not only did Fossil run afoul of\r\nRomag\u2019s patents for the metal components, Fossil was also accused of violating\r\nRomag\u2019s trademarks because the knock-off parts bore the \u201cROMAG\u201d mark. Moreover,\r\ndue to the existence of the agreement between the two parties in connection\r\nwith which Fossil agreed to use Romag closures for its profits, Romag contends\r\nthat Fossil knowingly adopted and used the Romag mark without its consent.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Trademark\r\ninfringement involves the unauthorized use of a trademark on or in connection\r\nwith goods and\/or services in a manner that is likely to cause consumers to be\r\nconfused, deceived, or mistaken as to the source of the goods and\/or services.\r\nWhen trademark infringement is found to be willful, the infringer is required\r\nto forfeit any profits realized from sale under the infringing mark. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; After\r\na jury trial, Fossil was found liable for both patent and trademark\r\ninfringement. The jury rendered advisory awards, including a reasonable royalty\r\naward of $51,000 for patent infringement and an award of $6.7 million of\r\nFossil\u2019s profits for willful trademark infringement. Thereafter, the District\r\nCourt reduced the patent damages award and simultaneously decided that Romag\r\ncould not recover Fossil\u2019s profits for trademark infringement because the jury\r\nhad not found the infringement to be willful. Rather, the jury had determined\r\nthat Fossil had acted with \u201ccallous disregard\u201d for Romag\u2019s trademark rights. Upon\r\nappeal, the United States Court of Appeals for the Federal Circuit affirmed the\r\naward.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nthe Federal Circuit appeal, Romag argued that Fossil cannot invoke a laches\r\ndefense to patent infringement and that the District Court erred in disallowing\r\nit from recovering Fossil\u2019s profits without proving that the infringer acted\r\nwillfully. Laches is a defense when the plaintiff has unreasonably delayed in\r\nmaking a claim and the defending party is prejudiced as a result. Regarding\r\nthis argument, the Federal Circuit determined that laches remains a defense to\r\nlegal relief in patent infringement cases because Congress codified the same.\r\nAs to Romag\u2019s contention that it is entitled to Fossil\u2019s profits regardless of\r\nwhether it proved that Fossil acted willfully, the Federal Circuit followed\r\nSecond Circuit precedent in finding that because Romag did not prove that\r\nFossil acted willfully, Romag is not entitled to recover Fossil\u2019s profits. The\r\ndecision regarding Fossil\u2019s profits was then appealed to the United States\r\nSupreme Court.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Through\r\nthis case, the Supreme Court will decide whether, under Section 35 of the\r\nLanham Act, 15 U.S.C. \u00a7 1117(a), willful infringement is a prerequisite for an\r\naward of an infringer\u2019s profits for a violation of Section 43(a), 15 U.S.C. \u00a7\r\n1125(a). Currently, across the twelve circuit courts, there exists a split of\r\nprecedents. In particular, six circuits, including the first, second, eight,\r\nninth, tenth, and District of Columbia, strictly require willful infringement\r\nin order to recover an award of infringer\u2019s profits. On the other hand, the\r\nremaining six circuits, including the third, fourth, fifth, sixth, seventh, and\r\neleventh, have interpreted amendments to the statute to permit an award of the\r\ninfringer\u2019s profits absent a finding of willful infringement, reasoning that\r\nCongress\u2019 failure to include the word \u201cwillfulness\u201d in the relevant section of\r\nthe statute indicated a desire to supersede the judicially created doctrine\r\nwhich requires willfulness. Instead, these circuits consider intent to be\r\nmerely one of several factors to be considered in balancing the equities. To\r\nresolve this circuit court split regarding willfulness, the Supreme Court\r\ngranted Romag\u2019s petition for writ of certiorari in June 2019.
