One lawsuit was filed in the Central\r\nDistrict of California, seeking damages and an injunction, and the other with\r\nthe International Trade Commission, seeking a ban on Google\u2019s infringing\r\ndevices. In particular, Sonos complains of the Google Home series as infringing\r\nmultiple of its issued patents.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Patent\r\nowners possess the exclusive legal right to exclude others from making, using,\r\nselling, or offering for sale the invention described in the claims. Patent\r\ninfringement occurs when a product or service meets all of the limitations of\r\nat least one independent claim of the patent. There is no requirement that the\r\nallegedly infringing party have knowledge of the existence of the patent in\r\norder to be held liable. However, if the infringing party did have knowledge of\r\nthe patent prior to the accused-of conduct, that party may be liable to the\r\npatent owner for up to three times the amount of damages assessed. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nits complaint, Sonos alleges to have pioneered the wireless multi-room audio\r\nsystem in the early 2000s. The company brought its first commercial product to\r\nmarket in 2005. The Santa Barbara-based company has been granted more than 750\r\npatents by the United States Patent and Trademark Office and currently has 420\r\npending patent applications. These patents cover various aspects of Sonos\u2019\r\nwireless multi-room audio system, including setting up a playback device on a\r\nwireless local area network, managing and controlling groups of playback\r\ndevices, and synchronizing playback of audio within groups of playback devices.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Prior\r\nto Sonos\u2019 innovation, multi-room audio systems were dependent on a centralized\r\nreceiver hard-wired to each individual passive speaker throughout a home or\r\nbusiness. Sonos changed this landscape by relying on intelligent, networked\r\nplayback devices to deliver sound wirelessly. Sonos alleges its system is easy\r\nto set up and use and is customizable and is readily integrated with other\r\ntechnologies and services. Moreover, Sonos\u2019 products are compatible with\r\nnumerous third-party music streaming services, many of which have integrated\r\ntheir services into the Sonos platform.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\n2013, Google and Sonos worked together through a partnership to integrate\r\nGoogle Play Music into the Sonos platform. During this partnership, Google\r\ngained knowledge of Sonos\u2019 patented multi-room technology. In particular,\r\nGoogle was able to view Sonos\u2019 proprietary technology in great detail due to\r\nthe especially deep integration of Google Play Music therewith. In 2014,\r\nGoogle\u2019s Google Play Music was launched on the Sonos platform. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Two\r\nyears after Google and Sonos partnered together, Google launched its first\r\nwireless multi-room audio product, Chromecast Audio, which is an audio\r\nadapter\/dongle that can turn a speaker with an auxiliary port into a wireless,\r\nnetworked speaker. This is the first device which Sonos claims infringes its\r\npatents. Since Chromecast Audio\u2019s release, Google has, according to Sonos,\r\nproliferated its use of Sonos\u2019 patented technology. Indeed, Google has produced\r\nmore than a dozen allegedly infringing products, including Google Home, Google\r\nHome Mini, Google Home Max, and Pixel phones, tablets, and laptops.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nthe complaint, Sonos lists five patents that were allegedly infringed by\r\nGoogle, though Sonos alleges that it believes Google violated roughly 100\r\ndifferent patents. Some of the features alleged by Sonos to be infringed by\r\nGoogle include setting up a playback device on a wireless local area network,\r\nadjusting group volume of playback devices, and synchronizing playback of audio\r\nwithin groups of playback devices. To make matters worse for Sonos, Google\r\nsells its Google Home Mini at a fraction of the cost of a Sonos comparable\r\nproduct. Google sells the Mini for $49 and has even offered them for free in a\r\npartnership with Spotify, thereby causing a massive influx of Google smart\r\nspeakers that will enter the market.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Sonos\r\nhas warned Google of its infringement on at least six separate occasions dating\r\nback to 2016. Specifically, Sonos first raised the issue of infringement in\r\nAugust 2016 and most recently by providing a pre-filing copy of the complaint\r\nto Google. In addition, Sonos alleges Google has been aware of Sonos\u2019 patents\r\nwell before August 2016. This is due, in part, to Sonos\u2019 previously-filed\r\npatent litigation against D&amp;M, another competitor of Sonos and Google, in a\r\nlawsuit which garnered media attention and resulted in a jury verdict for Sonos.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Interestingly,\r\nSonos publicly maintains that Amazon has similarly infringed upon its patented\r\ntechnology but claims it decided to sue only Google as they \u201ccouldn\u2019t risk\r\nbattling two tech giants in court at once.\u201d Unsurprisingly, similar to Google,\r\nAmazon denies such claims and maintains that the Echo family of devices was\r\ndeveloped independently by Amazon.
