Meanwhile, off the field, the Dallas Cowboys are prepared to take on\r\nthe 49ers in a court of law. In the 49ers\u2019 long march to the Super Bowl,\r\nlinebacker Kwon Alexander filed two trademark applications for \u201cHOT BOYZZ\u201d and\r\n\u201cHOT BOYZZ UNIVERSITY.\u201d Cowboys\u2019 defenders and, namely, DeMarcus Lawrence claim\r\nthey have been using the moniker since 2018 and that the 49ers copied it one\r\nyear later. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nOctober 2018, Tankland Ventures, LLC, an entity owned by DeMarcus Lawrence,\r\nfiled a trademark application for \u201cHOT BOYZ\u201d in International Class 025 for\r\nathletic shirts, athletic shorts, hats, hooded pullovers, and other types of clothing.\r\nThe application is an intent to use, or \u00a7 1(b), application, which means the\r\ntrademark is not currently being used in commerce. Interestingly, the term\r\n\u201cBOYS\u201d has been disclaimed from the mark, meaning that this portion of the mark\r\nhas been deemed unregistrable in that the word merely describes a category of\r\nclothing intended for male children. Because the application did not limit the\r\ngoods to a specific category of user, children\u2019s clothing for males is\r\ntherefore included within its scope. While Lawrence\u2019s application for \u201cHOT\r\nBOYS\u201d has been approved for publication by an examining attorney and has indeed\r\ncompleted its publication period, no statement of use has been filed yet. Once\r\nLawrence files a statement of use alleging that the mark is currently being\r\nused in commerce, the USPTO will likely proceed to register the mark.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; On\r\nthe other hand, Kwon Alexander filed applications for \u201cHOT BOYZZ\u201d and \u201cHOT\r\nBOYZZ UNIVERSITY\u201d mere months after Lawrence\u2019s filing. However, Alexander\r\nclaims a date of first use of January 1, 2016, while Lawrence has not filed any\r\nallegation of use for its mark. Identical to Lawrence\u2019s \u201cHOT BOYS\u201d application,\r\nAlexander seeks registration for its marks in International Class 025 for\r\nathletic shirts, athletic shorts, hats, hooded pullovers, etc. Earlier this\r\nseason, Alexander created shirts with \u201cHOT BOYZZ\u201d for his teammates and shouted\r\nout \u201cHOT BOYZZ UNIVERSITY\u201d during player introductions. While Alexander filed\r\nhis applications last week, it will likely be months before the USPTO takes any\r\nofficial action related thereto.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; To\r\nchallenge Alexander\u2019s mark, if the United States Patent and Trademark Office\r\n(USPTO) approves the same for publication, DeMarcus Lawrence may initiate an\r\nopposition proceeding before the Trademark Trial and Appeal Board (TTAB). Once\r\nthe USPTO determines that a party\u2019s mark is registrable, a thirty-day\r\nopposition period is initiated during which third parties may oppose the mark\u2019s\r\nregistration. The third party filing the opposition must allege a belief that\r\nhe or she would be damaged by the registration of the mark. Here, Lawrence\r\ncould oppose Alexander\u2019s mark on the ground that there exists a likelihood of\r\nconfusion due to the existence of his prior application for \u201cHOT BOYZ.\u201d <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Because\r\nAlexander\u2019s mark has not been published for opposition yet, Lawrence may file a\r\nletter of protest, which is an informal procedure that allows third parties to\r\nbring to the attention of the USPTO evidence bearing on the registrability of a\r\nmark. The most common ground for a letter of protest is a likelihood of\r\nconfusion with a United States trademark registration or prior pending\r\napplication, such as Lawrence\u2019s HOT BOYZ application. While letters of protest\r\nmay be submitted after the mark has been published, it is only accepted if the\r\nevidence supports a clear error on the part of the USPTO in approving the mark\r\nfor publication. After the thirty-day publication period, a letter of protest\r\nwill be denied as untimely.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; After\r\nthe publication period has expired and a trademark registers, a third party who\r\nobjects to registration of the mark may initiate a cancellation proceeding. A\r\nthird party, such as Lawrence, may attempt to cancel a trademark registration\r\nthat it believes may be damaging to its own trademark rights. Similar to\r\noppositions and letters of protest, grounds for cancelation may include\r\npriority and likelihood of confusion based thereon. Trademark cancellations may\r\nbe filed at any time within five years of the trademark registration date, or\r\nat any time if the trademark become abandoned, fraud is alleged in the mark\u2019s\r\nprocurement, or the mark becomes merely descriptive or generic of the goods or\r\nservices for which it is registered.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; While\r\nno official legal action has been taken yet, Lawrence tweeted that his \u201clegal\r\nteam has been monitoring the situation, and has already taken the steps to\r\nprotect our [trademark].\u201d Other Cowboys players, including Jaylon Smith, have\r\nspoken out to support Lawrence in this dispute.
