According to her complaint, she regularly posts\r\nphotographs of her work, as well as of random objects that look like unicorns\r\nvia her various social media profiles and websites. As part of her fascination\r\nwith unicorns, the plaintiff published a book consisting of her photographs of\r\nrandom objects appearing similar to unicorns, titled \u201cI See Unicorns.\u201d Overall,\r\nDaniher claims that unicorns have long been a central theme and subject matter\r\nof her artistic work. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; At\r\nissue in the present lawsuit is Daniher\u2019s dark blue\/purple 1972 Chevrolet G10\r\nvan. Since Daniher purchased her van in 2014, she has consistently posted\r\nimages and expressed her intention to paint a unicorn mural on the side\r\nthereof. Later in 2014, after implementing tremendous specificity regarding the\r\ncoloring and appearance of the van\u2019s unicorn mural, Daniher applied her design\r\nto the side of her van. Around the same time, she posted a photograph on\r\nInstagram of the mobile mural, thereafter christening it as the \u201cVanicorn.\u201d\r\nFollowing the \u201cvanicorn\u2019s\u201d publication revelation, Daniher and her vehicle have\r\nenjoyed considerable press and media attention<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Subsequent\r\nto publication of her vehicle\u2019s creative mural, Daniher was contacted by a\r\nrepresentative from Pixar inquiring about renting the \u201cvanicorn\u201d for a one-day\r\nsocial event\/musical festival taking place at Pixar\u2019s facility for its\r\nemployees in September of 2018. In the correspondence that followed, the Pixar\r\nagent allegedly represented that the van would be used as a \u201cshow piece\u201d and\r\n\u201cnot used in any way other than a visual prop.\u201d In addition, the parties\u2019\r\nagreement expressly limited the van\u2019s use to the production of Pixar\u2019s one day\r\nmusic festival\/activity day for employees and their families only. The parties\r\nagreed to the exchange of the vanicorn for three and a half days for a\r\nconfidential sum of money.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A\r\nfew months later, around May 2019, Daniher learned that Pixar was producing a\r\n3D computer animated motion picture, entitled \u201cOnward,\u201d about two blue elves\r\nwho are searching for a magical way to reunite with their deceased father. In\r\npursuit of this goal, the elves use the services of a third character,\r\n\u201cGuinevere,\u201d a dark blue\/purple van with a large mural of a unicorn on its\r\nside. Daniher alleges that the mural featured in the film is \u201ca direct copy\r\nand\/or visual duplication and\/or doppelganger\u201d of her vanicorn. Daniher\r\npublished on her Instagram account that the van featured in the defendants\u2019\r\nmotion picture infringed her van\u2019s copyright. A few days after Daniher posted\r\non her social media, Kori Rae allegedly called Daniher and apologized for the\r\ntheft of the vanicorn, openly admitting to such theft. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nher complaint, Daniher alleges copyright infringement of her vanicorn, for\r\nwhich she has registered a copyright with the United States Copyright Office.\r\nUnder the Copyright Act, Daniher possesses the exclusive right to publish,\r\ncopy, and distribute her work and these rights vested from the time of creation\r\nof her vanicorn. Because the tattoo artist is likely to argue direct copying,\r\ndue to Pixar\u2019s immediate access to her vanicorn (in addition to the van\u2019s extensive\r\nonline publication), she will need to prove that the two unicorn vans are\r\nsubstantially similar.
