In response, Quibi preemptively\r\nfiled a complaint in the United States District Court for the Central District\r\nof California seeking a declaratory judgment of non-inringement of Eko\u2019s patent\r\nand no misappropriation of trade secrets. The following day, Eko filed a\r\ncomplaint for patent infringement in the same court.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nQuibi\u2019s original complaint, the mobile-video company seeks relief from Eko\u2019s\r\nattempts to tarnish Quibi\u2019s brand and interfere with the highly anticipated\r\nlaunch of its platform. Quibi argues Eko\u2019s allegations result solely from the\r\nwidespread advertisement of Quibi\u2019s high-profile novel service. In particular,\r\nQuibi believes Eko is attempting to capitalize on Quibi\u2019s early acclaim through\r\n\u201cdemonstrably false claims of intellectual property infringement.\u201d<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Quibi\r\nexplains that two weeks after it announced its innovative platform at CES, an\r\nindustry conference, Eko\u2019s attorneys sent a demand letter to Quibi asserting\r\nthat its turnstyle feature employs technology disclosed in Eko\u2019s patent,\r\nthereby demanding Quibi immediately cease use of this proprietary technology.\r\nQuibi responded to the letter asserting its position but Eko proceded to\r\ncontact a technology reporter to reiterate its false allegations and also, sent\r\na notice to Apple, Inc. alleging Quibi\u2019s app infringes Eko\u2019s patent. Finally,\r\nEko repeated its allegations to a reporter and editor of the <em>Wall Street Journal. <\/em>As a result of the\r\nforegoing, Quibi maintains its reasonably apprehended a lawsuit against it &nbsp;that could wrongfully impact its ability to\r\nrelease its service.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Quibi\r\nis an upcoming short-form mobile video platform set to launch April 6<sup>th<\/sup>.\r\nQuibi utilizes an innovative technology designed to display television shows\r\nand movies on a small screen, such as that found on a smartphone. The platform\r\nwas designed to optimize customer-viewing experience on a mobile device\r\nregardless of whether the phone was being held in portrait or landscape mode.\r\nAs such, Quibi strove to create new technology capable of streaming video\r\ncontent that seamlessly adapted to those changes in orientation. Moreover, each\r\nepisode is delivered in ten minutes or less, known as a \u201cquick bite.\u201d This\r\nservice is targeted toward a younger demographic who commonly experience\r\ndecreasing time and attention spans and increasing use of mobile devices. As of\r\nits launch, Quibi plans to offer more than fifty titles.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nits complaint, Eko complains that Quibi\u2019s turnstyle mobile-video technology\r\ninfringes United States Patent No. 10,460,765 for \u201csystems and methods for\r\nadaptive and responsive video.\u201d Unlike the prior art, Eko\u2019s patented feature does\r\nnot crop or letterbox a presentation but instead, provides seamless transition\r\nfrom a first state of a video presentation to a second state of a video\r\npresentation. Eko asserts that, starting in 2015, and through 2018, Bloch met\r\nwith three former Snap, Inc. employees under a nondisclosure agreement to\r\nintegrate Eko\u2019s technology into the Snapchat application. Three of those former\r\nSnap employees joined Quibi mere weeks prior to Quibi filing for its own patent\r\non the turnstyle feature.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Both\r\ncomplaints address meetings that took place between the founders of the\r\nrespective companies. In its separate complaint, Eko argues that, in 2017,\r\nQuibi\u2019s founder, Jeff Katzenberg, met with Eko\u2019s founder\/Chief Executive Officer,\r\nYoni Bloch, to discuss a potential investment in Eko. Eko claims to have\r\ndemonstrated its horizontal-to-vertical video technology. Ultimately, however,\r\nKatzenberg declined to invest in Eko. Quibi, in its complaint, asserts that no\r\nconfidential information was requested nor provided during the one-time meeting\r\nof the companies\u2019 founders. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Traditionally,\r\npatents and trade secrets have presented opposite choices. Trade secrets derive\r\nprotection through reasonable efforts to maintain secrecy and could\r\ntheoretically last indefinitely. On the other hand, patents are only\r\nprotectable through public disclosure. Indeed, patents are obtained through\r\nfiling a patent application which discloses exactly what the inventor purports\r\nto be his invention. In addition, a patent only lasts a period of twenty years,\r\nupon the expiration of which the inventor\u2019s monopoly is released for public\r\nuse.
