Following a motion to dismiss by defendants,\r\nMashable and parent company, Ziff Davis, the court held no copyright\r\ninfringement had occurred by embedding the Instagram photo in an article. As a\r\nresult, the plaintiff\u2019s, Stephanie Sinclair, complaint for copyright\r\ninfringement was dismissed. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\r\ndispute began in March 2016, when an article titled \u201c10 female photojournalists\r\nwith their lenses on social justice\u201d was published. The article highlighted the\r\nwork of ten female photographers whose work focuses on social justice. One of\r\nthe photojournalists featured, Sinclair, shoots for <em>National Geographic <\/em>and\r\naims to protect girls\u2019 rights and end child marriage by documenting sensitive\r\nhuman rights topics internationally. With a particular focus on gender issues,\r\nSinclair most frequently shoots the subjects of child marriage and\r\nself-immolation. At issue is one photograph in particular, titled \u201cChild,\r\nBride, Mother\/Child Marriage in Guatemala.\u201d Mashable initially offered Sinclair\r\n$50 for rights to this photograph for the article. When Sinclair declined,\r\nMashable embedded the image from Sinclair\u2019s official Instagram account. Shortly\r\nthereafter, Sinclair filed a lawsuit for copyright infringement.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In\r\nincluding Sinclair\u2019s Instagram photo in their article, Mashable used a process\r\ncalled \u201cembedding.\u201d This technical process allows a website coder to\r\nincorporate content that is located on a third-party\u2019s server into the coder\u2019s\r\nwebsite. When users visit said website, the user\u2019s Internet browser retrieves\r\nthe embedded content from the third-party server and displays it on the\r\nwebsite. Thus, the user sees the embedded content on the website, despite the\r\nfact of it actually being hosted on a third-party\u2019s server. Instagram uses an\r\n\u201capplication programming interface,\u201d or \u201cAPI,\u201d to enable users to access and\r\nshare content posted to \u201cpublic\u201d accounts, such as Sinclair\u2019s. Here, Mashable\r\nused the API to embed Sinclair\u2019s photograph from her Instagram account to their\r\narticle.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Previously,\r\nthe nature of this lawsuit revolved around the server test. This doctrine\r\nfocuses on the fact that a publication which uses a photo-embed code never\r\nstores the photo on its own servers or transmits it to the user. Rather, the\r\nembed code instructs the user\u2019s Internet browser how to download the image\r\ndirectly from another site. In this case, the other site was Instagram, and\r\nparticular, Sinclair\u2019s official, public account. A majority of courts have\r\nfound such use of third-party content to not constitute copyright infringement\r\nbecause the publisher is not distributing or displaying the content to users. Other\r\ncourts, including the Southern District of New York, have found infringement in\r\nthese instances claiming the technical details of how the photograph reached\r\nthe user\u2019s browser does not overshadow the fact that the news websites caused\r\nthe photo to appear on user\u2019s browsers without permission from the copyright\r\nholder. Problematically, under the server test, those who evaded liability for\r\ndirect infringement could still be held liable for indirect copyright\r\ninfringement.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Instead\r\nof relying on the server test, Mashable argued Sinclair granted a license to\r\nInstagram to use her photo when she uploaded it. In addition, Instagram\u2019s terms\r\nof service state that it has the right to sub-license the photo to others. A\r\ncopyright owner who permits a licensee to grant sublicenses cannot bring an\r\ninfringement suit against a sublicensee, so long as the licensee and sublicensee\r\nhave acted within the terms of their license and sublicense, respectively.\r\nIndeed, a sublicensee cannot acquire valid rights to copyrighted works if the\r\nsublicensor had no right to issue a sublicense in the first place.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; By\r\nusing Instagram\u2019s embedding service, Mashable was lawfully sublicensing the\r\nphoto from Instagram. The court agreed with this argument in finding no\r\ncopyright infringement had occurred. This licensing-based reasoning clearly\r\ndistinguishes between authorized and unauthorized social media uploads. Importantly,\r\nthrough a site like Instagram, which is automatically granted a license to\r\ncontent uploaded to its platform, the user who uploads content may disable any\r\nthird-party use of the same by marking the post as private. Sinclair appears to\r\nhave done just that as her photograph no longer appears in Mashable\u2019s article. Moreover,\r\nany sublicense arising out of an Instagram-posted photo is limited to the\r\nembedding tool.
