As a result, use of\r\nlivestreaming platforms, such as Zoom, Google Hangouts, WebEx, as well as,\r\nInstagram Live, Facebook Live, and YouTube, has significantly increased.\r\nBusinesses of all types have also started using livestreaming platforms to\r\nprovide services that were previously delivered in person. These services range\r\nfrom religious services, educational services, and fitness classes to weddings,\r\nfunerals, graduations, and other social events. Because many of these\r\nlivestreams include unoriginal audio or audiovisual content, copyright concerns\r\nexist.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; As\r\none example, legendary DJ D-Nice has been offering a daily \u201cHomeschool at Club\r\nQuarantine\u201d livestream series on Instagram Live in an attempt to bring a dance\r\nparty into everyone\u2019s homes. The now-viral stream started out as an attempt to\r\nchange DJ D-Nice\u2019s own feelings of isolation and now frequently features drop\r\nins by famous celebrities, such as Drake, Jennifer Lopez, Michelle Obama, Dave\r\nChappelle, Oprah Winfrey, and Mark Zuckerberg. According to DJ D-Nice\u2019s\r\nrepresentatives, Instagram arranged for broadcasting licensing for DJ D-Nice\r\nsuch that his use of copyrighted music does not constitute copyright\r\ninfringement.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Copyright\r\nprotects original works of authorship, including literary, dramatic, musical,\r\nand artistic works. Under the United States Copyright Act, copyright owners\r\npossess various rights, including the right to perform the work publicly.\r\nCopyright infringement occurs when someone publicly performs the musical\r\ncomposition, broadcasts an audiovisual work, such as a motion picture or\r\ntelevision program, without permission from the copyright owner. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; For\r\nmusical works, there are two separate copyrights that are frequently held by\r\ndifferent parties. The songwriting copyright is possessed by the songwriter\r\nwhile the sound recording copyright is often held by the record label. Performing\r\nrights organizations license, collect, and distribute public performance\r\nroyalties for songwriters and publishers. Through these contracts, songwriters\r\nand publishers are entitled to collect a royalty each time their song is played\r\non the radio, at a restaurant, retail establishment, fitness studio, park\r\ndistrict facility, or online. In return, the performance rights organization\r\nprovides a \u201cblanket\u201d license allowing the facility or service to broadcast the\r\nsongs in the organization\u2019s catalog. Livestreaming platforms typically do not\r\nhave blanket licenses covering a user\u2019s use or performance of a musical work\r\nover the platform. However, as mentioned previously, DJ D-Nice\u2019s \u201cHomeschool\u201d\r\nlivestream appears to be under such a license.<\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; While\r\na popular service, Instagram\u2019s policies regarding copyright and the chance of\r\nbeing muted or interrupted in the middle of a livestream remain uncertain at\r\nbest. Instagram\u2019s computers detect each and every note that is played in a\r\nvideo that is posted, livestream or otherwise. When Instagram detects\r\ncopyrighted material in a livestream video, the stream is cut off, and the\r\nstreamer and the audience are both kicked out to the home page. This forces the\r\nstreamer to start its stream over, undoubtedly losing audience members in the\r\nprocess. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; For\r\ninstance, various gyms and fitness studios have begun livestreaming classes\r\nwhich, almost invariably include, music. Instructors must be careful in\r\nselecting their tunes so as to avoid triggering Instagram\u2019s copyright infringement\r\nalgorithm. Kicking the instructor and the class members out of the feed kills\r\nthe vibe and disengages the audience. As one solution, some instructors have\r\ndecided to use only remixes or lesser-known music. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; As\r\nanother example, DJs that are lesser known than DJ D-Nice (and therefore are\r\nless likely to have a separate agreement with Instagram) constantly suffer the\r\nrisk of any song clip they play triggering the algorithm. Some DJs have noticed\r\nthat the takedowns are triggered by the duration of copyrighted content. These\r\nDJs have therefore avoided Instagram by quickly switching between songs and,\r\nalso, playing less popular music. Notably, such \u201csolutions\u201d may still\r\nconstitute copyright infringement but are less likely to cause an interruption\r\nin the livestream. <\/p>\r\n\r\n\r\n\r\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Penalties\r\nfor copyright infringement can be expensive. In addition to actual damages for\r\ninfringement, if the copyright is registered, the copyright owner may be\r\nentitled to recover statutory damages. Statutory damages range from $750 to\r\n$30,000 per work and even up to $150,000 if the infringement was willful. While\r\nthis country follows the American rule that each party is responsible for\r\npaying its own attorneys\u2019 fees, per statute, the copyright owner can also\r\ncollect attorneys\u2019 fees and court costs.
