Despite being<br \/>\nunder the same umbrella term, <a href=\"https:\/\/www.uspto.gov\/trademarks\/basics\/trademark-patent-copyright\" target=\"_blank\" rel=\"nofollow noopener\"><strong>different types<\/strong><\/a> of intellectual property have different types of<br \/>\nprotections.<\/p>\n<p>This article provides a brief overview of what it means to have copyright, patent, or trademark<br \/>\nprotection.<\/p>\n<h2><strong>Copyrights<\/strong><\/h2>\n<p><a href=\"https:\/\/omnilegalgroup.com\/copyrights.html\"><strong>Copyright law<\/strong><\/a> protects original works of art, such as books, songs, art, photographs, and videos.<br \/>\nIn the United States, an author or creator <a href=\"https:\/\/www.copyright.gov\/help\/faq\/faq-general.html\" target=\"_blank\" rel=\"nofollow noopener\"><strong>automatically has copyright ownership<\/strong><\/a> of a work when<br \/>\nit\u2019s created.<\/p>\n<p><a href=\"https:\/\/www.copyright.gov\/registration\/\" target=\"_blank\" rel=\"nofollow noopener\"><strong>Registering<\/strong><\/a> your work with the U.S. Library of Congress gives you certain benefits, including:<\/p>\n<ul>\n<li>The right to reproduce the work, such as by selling copies of a book or movie;<\/li>\n<li>The right to display or perform the work publicly;<\/li>\n<li>The right to license the work to others; and<\/li>\n<li>The right to file a lawsuit claiming copyright infringement.<\/li>\n<\/ul>\n<p>Copyright protection for works created in 2022 are <a href=\"https:\/\/www.copyright.gov\/help\/faq\/faq-duration.html\" target=\"_blank\" rel=\"nofollow noopener\"><strong>valid<\/strong><\/a> for the life of the author and 70 years,<br \/>\nwith no renewal requirements.<\/p>\n<h2><strong>Patents<\/strong><\/h2>\n<p>There are two types of patents: <a href=\"https:\/\/omnilegalgroup.com\/patents\/utility-patent.html\"><strong>utility patents<\/strong><\/a> and <a href=\"https:\/\/omnilegalgroup.com\/patents\/design-patent.html\"><strong>design patents<\/strong><\/a>. Utility patents protect<br \/>\ninventions, while design patents protect non-functional decorative elements of an invention.<br \/>\nPatents can protect physical items, like the latest smartphone, and mechanical processes, as well<br \/>\nas chemical compounds found in pharmaceuticals, and even software code.<\/p>\n<p>Unlike copyrights, <a href=\"https:\/\/omnilegalgroup.com\/patents.html\"><strong>patents<\/strong><\/a> give the patent holder the right to prohibit others from making, selling, or otherwise distributing the invention. For example, a computer repair company could register their trademark for the service<br \/>\nthey provide as well as their advertising materials, but would not be able to use the mark, and<br \/>\ncould not prohibit others from using a similar mark, if utilized by a guitar manufacturer.
