{"id":509,"date":"2018-06-05T23:17:33","date_gmt":"2018-06-05T23:17:33","guid":{"rendered":"https:\/\/omnilegalgroup.com\/blog\/?p=509"},"modified":"2019-01-18T12:20:09","modified_gmt":"2019-01-18T12:20:09","slug":"happytime-murders-lawsuit","status":"publish","type":"post","link":"https:\/\/omnilegalgroup.com\/blog\/happytime-murders-lawsuit\/","title":{"rendered":"District Court Denies TRO Against Allegedly Infringing Use of Tagline"},"content":{"rendered":"<p><a href=\"https:\/\/omnilegalgroup.com\/blog\/wp-content\/uploads\/2018\/06\/Screen-Shot-2018-06-05-at-4.15.02-PM.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-510\" src=\"https:\/\/omnilegalgroup.com\/blog\/wp-content\/uploads\/2018\/06\/Screen-Shot-2018-06-05-at-4.15.02-PM-150x150.png\" alt=\"\" width=\"177\" height=\"177\" \/><\/a><\/p>\n<p>The creators behind a raunchy comedy featuring Melissa McCarthy and cast of puppets are being sued by the educational nonprofit organization behind \u201cSesame Street.\u201d McCarthy portrays a police officer who teams up with a new puppet partner to solve \u201cthe brutal murders of the former cast of a beloved classic puppet television show.\u201d Sesame Workshop, the nonprofit, claimed the new film, titled \u201cThe Happytime Murders\u201d through its creators, STX Productions, wrongfully misappropriates the \u201cSesame Street\u201d trademark, trusted brand, and goodwill for promotional purposes. The complaint further alleges that defendants do not own or have any right to the \u201cSesame Street\u201d mark and that the trailer deliberately confuses consumers into mistakenly believing that Sesame Workshop is in some way associated with or has endorsed the R-rated film. In particular, the nonprofit organization took issue with the film\u2019s tagline \u201cNo Sesame. All Street.\u201d<\/p>\n<p>For these reasons, Sesame Workshop sought a temporary restraining order barring STX Productions from continuing to use the tagline but such order was denied.
