{"id":556,"date":"2018-08-15T16:22:18","date_gmt":"2018-08-15T16:22:18","guid":{"rendered":"https:\/\/omnilegalgroup.com\/blog\/?p=556"},"modified":"2019-01-18T11:58:15","modified_gmt":"2019-01-18T11:58:15","slug":"michaeljackson-disney-copyrightinfringement","status":"publish","type":"post","link":"https:\/\/omnilegalgroup.com\/blog\/michaeljackson-disney-copyrightinfringement\/","title":{"rendered":"Disney\u2019s \u201cThe Last Days of Michael Jackson&#8221;: fair use or copyright infringement?"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/omnilegalgroup.com\/blog\/wp-content\/uploads\/2018\/08\/Michael-Jackson.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-557 aligncenter\" src=\"https:\/\/omnilegalgroup.com\/blog\/wp-content\/uploads\/2018\/08\/Michael-Jackson-150x150.jpg\" alt=\"\" width=\"186\" height=\"186\" \/><\/a><\/p>\n<p>The Walt Disney Company recently moved to dismiss a copyright infringement lawsuit brought against it by the estate of Michael Jackson. \u201cThe Last Days of Michael Jackson,\u201d the subject of the lawsuit, was aired by ABC earlier this year as a documentary television retrospective on the star\u2019s Jackson 5 years to his final days. In essence, the estate claims the documentary features copyright-protected videos and songs owned exclusively by the estate and without ever seeking permission for the same. In response, Disney continues to maintain its documentary constitutes fair use.<\/p>\n<p>In its complaint, Michael\u2019s Jackson\u2019s estate focuses on the irony of Disney\u2019s previous zealously advocation of intellectual property rights. In particular, the estate notes that the entertainment company\u2019s \u201czeal to protect its own intellectual property from infringements, real or imagined, often knows no bounds.\u201d The estate goes further to cite three sympathetic examples of how Disney used its power to force others to comply with its intellectual property will.\u00a0 First, the estate cites threats made by Disney against independent child care centers for having pictures of Mickey Mouse and Donald Duck on their walls, forcing the centers to remove the pictures from their walls. Another example is a lawsuit seeking one million dollars brought against \u201ca couple on public assistance\u201d who had been appearing as Tigger and Eeyore at children\u2019s parties. Lastly, and perhaps the most relevant to Disney\u2019s fair use defense, the complaint cites DMCA takedown notices sent by Disney to Twitter, Facebook, and the like, when consumers posted pictures of Star Wars toys the consumers had legally purchased. Through these examples, Michael Jackson\u2019s estate attempts to paint the picture that Disney \u201chas never been shy about protecting its intellectual property.\u201d<\/p>\n<p>In light of Disney\u2019s rigorous intellectual property protection, the estate claims it is particularly egregious that Disney has so blatantly used Michael Jackson\u2019s works without seeking a license from the estate. Indeed, the complaint states \u201cDisney\u2019s passion for the copyright laws disappears when it doesn\u2019t involve its own intellectual property and it sees an opportunity to profit off of someone else\u2019s intellectual property without permission or payment.\u201d Even more, the estate\u2019s grievance is aggravated by the quantity of copyrighted works used by Disney in its special. \u201cThe Last Days of Michael Jackson\u201d purportedly used at least thirty different copyrighted works including, \u201csubstantial portions of some of Michael Jackson\u2019s most famous music,\u201d such as <em>Billie Jean<\/em>, <em>Beat It<\/em>, <em>Don\u2019t Stop \u2018Til You Get Enough<\/em>, <em>The Girl is Mine<\/em>, and <em>Leave Me Alone<\/em>. Moreover, the two-hour special features \u201cextensive parts of Michael Jackson\u2019s copyrighted music videos,\u201d including <em>Michael Jackson\u2019s Thriller<\/em>, <em>Billie Jean<\/em>, <em>Black or White<\/em>, and <em>Childhood<\/em>.<\/p>\n<p>While Disney admits to having utilized \u201cshort excerpts\u201d from Michael Jackson\u2019s songs and videos, the company contends its use is \u201climited.\u201d Disney contends these works are used solely for the purpose of providing historical context and explanation tracing the arc and aspects of Michael Jackson\u2019s life and career. Furthermore, Disney claims that in most instances in its documentary special \u201cwell less than 1&amp; of the works\u201d were reproduced.<\/p>\n<p>Disney\u2019s primary argument to Michael Jackson\u2019s estate\u2019s complaint is that its film qualified as a documentary and therefore, that its \u201climited\u201d use of the copyrighted material was fair game. Specifically, Disney argues that per its right of free speech under the First Amendment and the doctrine of fair use under the Copyright Act, its use was completely permissible. For a use of copyrighted work to be classified as a \u201cfair use,\u201d it must be done for a limited and transformative purpose. Generally speaking, most fair use qualifies as either commentary\/criticism or parody. It follows, therefore, that Disney contends it is allowed to limited use of the estate\u2019s copyrighted works for the purpose of reporting on, commenting on, teaching about, and criticizing a well-known public figure.<\/p>\n<p>Michael Jackson\u2019s estate seeks to hold Disney liable for ABC, Inc.\u2019s release of \u201cThe Last Days of Michael Jackson\u201d under an agency theory. Specifically, ABC is a wholly-owned subsidiary of The Walt Disney Company. Moreover, the estate contends Disney had knowledge of ABC\u2019s \u201cplanned infringing activity\u201d as its General Counsel was sent numerous letters in the days prior to the special\u2019s airing and ignored the last two letters.
